Owner Builder vs Licensed Builder in NSW: The Real Risks and Costs

Being an owner builder can look like a way to save the builder's margin. For some people with time, experience and a simple project, it works. For many, the hidden responsibilities, risk and time cost outweigh the savings. Here is what is involved in NSW.

What is an owner builder?

An owner builder is a property owner who takes on the role of the builder for work on their own home. You are responsible for organising the work, engaging and supervising licensed trades, managing safety on site, and making sure the work complies with the approvals and the National Construction Code.

NSW owner builder permit requirements

  • An owner builder permit is required for residential building work over $10,000 that needs development consent or a complying development certificate.
  • For work over $20,000, you must complete an approved owner builder course before applying.
  • Permits apply to a dwelling, dual occupancy or secondary dwelling on land you own, and there are limits on how often you can hold one.
  • Licensed trades are still required for specialist work such as electrical, plumbing and gas.

Your responsibilities as an owner builder

  • Work health and safety: you are the person conducting the business on site, responsible for the safety of workers and the public.
  • Compliance: work must meet the approved plans, NCC and Australian Standards, and pass inspections.
  • Insurance: you need to arrange appropriate insurances, such as construction and public liability cover.
  • Coordination: scheduling trades, ordering materials, managing variations and solving problems on site.

Selling an owner-built home

If you sell within the statutory warranty period, owner builders generally owe statutory warranties to the purchaser for their work, and home building insurance may be required before sale. Buyers and their lenders often look closely at owner-built homes, which can affect price and time on market.

Where owner building goes wrong

  • Underestimating the time it takes to manage trades.
  • Gaps in scope between trades, leading to defects and disputes.
  • Structural, waterproofing or drainage work not done to standard.
  • Costly delays waiting on inspections and rework.

The middle ground: a licensed builder or project manager

A licensed builder takes responsibility for the whole job, carries the insurances and statutory warranties, and coordinates engineers, certifiers and trades. For complex or structural projects, that accountability is often worth more than the margin saved.
